Save Me App (“we” or “us”) pilots an online portal and app service for mobile devices (“Platform”) for the disposition of the reservation of food and other products (“Products”) by restaurants, hotels, supermarkets, bakeries and other retailers (collectively,” Stores”) that have been onboarded on the Platform to end-users (“Consumers”, “you” or “your”). These Terms and conditions (“Terms of Service”) govern your use of the Save Me App (“App”) available for download from the Platform and App Store and Android (collectively, the “Service”). Your use of the Gateway and Services is governed by the following Terms of Use and all applicable laws. BY ACCESSING OR USING ANY PORTION OF THE PLATFORM, YOU ACCEPT THESE TERMS WITHOUT LIMITATION OR QUALIFICATION. IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING TERMS, DO NOT USE ANY PART OF THE PLATFORM. THESE TERMS INCLUDE AN ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER. PLEASE READ CAREFULLY AS THEY AFFECT YOUR RIGHTS.

1. Introduction

Save Me's mission is to promote awareness and combat food waste globally by facilitating access to surplus food products. We offer a platform for consumers to place orders for surplus groceries and other excess items. These terms apply to all product orders made through our platform, where you can choose either pickup or delivery options for your food. Our Platform is provided for your personal, non-commercial use and informational purposes only. Any other use of the Service requires Save Me's prior written consent. Save Me's Cookies and Privacy Policy, available at any time on the Platform, form an integral part of these Terms and are automatically accepted upon acceptance of these Terms. Save Me's Cookie and Privacy Policy is incorporated herein by reference. Communications with Save Me can be sent to Save Me through the contact page of the Platform or App.  

2. Save Me Concept

The Save Me application operates by listing products as items within the app. When a user selects a specific product, they are presented with two choices: pickup or delivery. Opting for pickup allows the user to collect the item directly from the store at the specified time. On the other hand, if the user prefers delivery, they can select between scheduling it for immediate dispatch or setting a later delivery time. It's important to note that Save Me is responsible for managing the order process from the store to the consumer or user. However, there is no contractual relationship between Save Me and the consumer regarding the products or the sale of products, as these transactions are conducted directly between the store and the consumer. Save Me's primary responsibility lies in ensuring the successful fulfilment of the order.

3. Acceptance

When placing an order on the Platform, the Customer confirms:
  • To have the capacity to enter into legally binding contracts;
  • Consumers shopping for personal purposes,
  • be 18 years of age or older and have a valid debit card, credit card, or other means of payment available for payment on the Platform; and
  • If the Consumer is under the age of 18, the Consumer uses the Services under the supervision of an adult over the age of 18. In this case, adult users are considered users of the Service. If you are under the age of 13, you may not use the Service under any circumstances or for any reason.
By placing an order on the Platform, the Consumer represents and warrants that the Consumer: have the capacity to enter into legally binding contracts; Consumers shopping for personal purposes, be 18 years of age or older and have a valid debit card, credit card, or other means of payment available for payment on the Platform; and If the Consumer is under the age of 18, the Consumer uses the Services under the supervision of an adult over the age of 18. In this case, adult users are considered users of the Service. If you are under the age of 13, you may not use the Service under any circumstances or for any reason. Further, by agreeing to these terms, the consumer agrees to receive emails and text messages related to each pre-order placed by the consumer. This is used by Save Me to ensure your consumers receive all important notifications related to pre-orders. Save Me reserves the right to revise and change these Terms from time to time. A consumer's pre-order is subject to the terms and conditions in effect at the time the consumer places the pre-order. Further, by agreeing to these terms, the consumer agrees to receive emails and text messages related to each pre-order placed by the consumer. this is, Use Save Me to ensure your consumers receive all important notifications related to pre-orders. Save Me reserves the right to revise and change these Terms from time to time. A consumer's pre-order is subject to the terms and conditions in effect at the time the consumer places the pre-order.

4. Registration

In order to place a Pre-Order (as defined below) through the Platform on any of the Stores, you must register for an account on the Platform (“Account”) in one of the following ways: (ii) Use of Mobile Verification. or (iii) log in via Facebook Connect, or other supported authentication mechanism (“Third Party Account”). You must provide accurate and complete information and keep your account information up to date. (i) impersonate another person by choosing or using that person's name as a username; (ii) use as a username any name that is subject to the rights of anyone other than you without proper authorization; or (iii) use an offensive, vulgar or obscene name as your username. You are solely responsible for the activity that occurs on your account and for keeping your account password secure. You must not use another person's account or registration information for this service without permission. You must notify us immediately of any change in your rights to use the Service, any breach of security, or any unauthorized use of your account. Do not publish, distribute or post your account login information. For more information on how we use and protect your personal information, please see our Privacy Policy.

6. Product and Product Information

Save Me only facilitates the booking of Products between Consumers and Stores and Save Me assumes no responsibility for the performance of any contracts between Products or Stores and Consumers. Save Me does not manufacture, sell, purchase, prepare, produce, process, label any Products. Save Me fulfills and adheres to pre-orders related to the Products, including the manufacture, sale, purchase, storage, preparation, production, processing, labeling, delivery, quality, ingredients, allergens, or product handling of the Products. We are not responsible for any Applicable Regulations Laws and regulations, including those related to the above. Consumers can find information and product descriptions about products on the platform. This information is for illustrative purposes only and is intended to provide consumers with the best possible conditions to evaluate the products they have selected before placing a pre-order. Actual product ranges, inventory items, etc. may not match those shown on the Platform. In such cases, Save Me assumes no liability. The Store is responsible for providing information about its products and ensuring that the information is accurate and up to date. Save Me is not responsible for the information provided by the Store and therefore is not responsible for the availability of any content or information related to the Products on the Platform. If you have any questions about allergy indications, product content, or other menu information, please contact the store directly before purchasing. Save Me is not responsible for any ingredient, allergy, calorie, or other nutritional information provided by the Store or found on the Platform. It is the consumer's and merchant's responsibility to determine if allergens are present in the product. In case of pickup order by the customer, the Store will provide consumers with information at the time of collection (as defined below) regarding ingredient lists, allergens, and other label-related information regarding the Products., and/or must be consumed as indicated on the product label or on the store. If not, we are not responsible for any adverse effects on the product by the consumer for any reason. Save Me is not liable or responsible for any failure to perform or any delay in the performance of any obligations relating to the Products, including with respect to manufacturing, sale, purchase, storage, preparation, production, processing, marking, delivery, quality, ingredients, allergens or handling of the Products.

7. Ordering Process

A list of active stores can be found on the platform. If the consumer has allowed the platform to use location services, the platform will track the consumer's location, and the list will show stores near the consumer. You can place an order with ease from the available stores, with the choice to opt for either pickup or delivery. When you select the pickup option, you'll have the convenience of collecting your order from the store at a specific time indicated on the store's profile. To streamline this process, a reference number will be requested at the cashier's counter, which serves as the basis for preparing and handing over your order. For delivery preferences, you have two options: "Deliver Now" or "Scheduled Delivery. With "Deliver Now," your order will be promptly prepared and dispatched to your doorstep by Save Me's dedicated rider. Alternatively, with "scheduled delivery," you have the flexibility to choose a delivery time slot that aligns with your schedule. This time slot will be visible during the ordering process, ensuring that your delivery is coordinated according to your convenience.

8. Order Confirmation

Once an order is placed through the app, you will receive a confirmation notification on your screen, affirming that your order has been successfully placed. This notification will also provide you with an estimated time for delivery. As the restaurant begins preparing your order, a subsequent notification will appear, informing you that your order is now in the preparation phase. Once your order is ready for dispatch, the app will notify the assigned rider, who will promptly pick up your order and ensure its timely delivery to your doorstep.

9. Right of Cancellation

Because the Products are perishable goods, and because Save Me’s concept is to avoid waste of food and other products, the Consumer cannot cancel the order once placed.

10. Refund

If a customer places an order for an item that is unavailable, the refunded amount, excluding transactional fees, will be reimbursed to the user in the form of a promo code credited to their Save Me wallet. This promo code can then be utilized for future purchases.

11. Pick-up

Products reserved for pickup on the platform must be collected by the consumer at the stated pickup address ("pickup"). Store descriptions and details about when and where the products can be picked up will appear on the platform and are stated in the reservation confirmation as well. Upon pickup, consumers are required to show store staff their reservation confirmation on the Save Me app to collect their pickup orders. It is the consumer's responsibility to ensure that the in-app booking confirmation is available for presentation upon pickup.

12. Delivery

When you access our platform and click on the "Delivery" option, you'll find two convenient choices for getting your food: 1.Delivery Now: By choosing this option, your order will be promptly delivered to your designated doorstep by one of our dedicated riders. 2.Scheduled Delivery: With scheduled delivery, you have the flexibility to choose the specific time at which you would like your order to be delivered. It is essential that you are present at the designated delivery location at the scheduled time. If you are unavailable, our rider will attempt to contact you via phone to coordinate the delivery. If there is no response or if you are not present at the scheduled time, your food will be left outside the designated delivery location. Please bear in mind that the estimated delivery time displayed on the app is an approximation and may be subject to variation due to factors such as traffic, weather conditions, and order volume. In the event of any significant delay beyond the estimated time, our rider will make every effort to promptly inform you through a phone call and provide you with updates on the status of your order.

13. Price

All prices are in A.E.D currency and exclude applicable sales tax.

14. Payment

Consumers can pay with various branded debit and credit cards and other payment methods available on the platform. When using a credit or debit card, consumers are required to enter the card number, expiration date, and security code at the time of pre-order. Upon placing a Reservation Order, the price stipulated by the Store for the Products (“Purchase Price”) is authorized or reserved at the Consumer ́s account (depending on the chosen payment method) (“Account”). The Purchase Price is charged at the Consumer ́s account upon reservation of the Product or at or immediately after Pick-up (depending on the chosen method of payment). If the Reservation Order is cancelled in accordance with these Terms, the Purchase Price is cancelled or refunded to Consumer. The Purchase Price is collected by Save Me from the Consumer on behalf of the Store. Save Me may amend, modify or restructure the payment procedure for its Consumers, as it deems reasonable. The Platform uses PCI compliant Payment Service Providers. Payment by debit or credit card on the Platform is safe and certified by the card issuer. All payments are made through an encrypted internet connection. Save Me does not store any debit or credit card information. Such information is handled by the Payment Service Providers. However, such information may be stored by the Payment Service Providers. If the Consumer’s credit card or payment method is rejected when trying to pay for a Reservation Order, the Consumer should verify that the entered information is correct. If the Consumer has corrected the error and the credit card is still rejected, Save Me recommends that the Consumer contact his or her bank. Due to standard banking procedures, once the Consumer has submitted a Reservation Order by use of a credit or debit card and the payment has been authorized, the bank or card issuer will reserve the full amount of the Reservation Order In the event that a pickup order is subsequently rejected by the store or canceled for any other reason in accordance with these terms, the bank or card issuer will not transfer the funds for the order to Save Me and will instead refund the consumer by releasing the relevant amount back into the consumer’s available balance. However, this may take up to 10 working days (or longer, depending on the consumer’s bank or card issuer), and Save Me does not have the authority to make inquiries to a consumer’s bank or card issuer on specific payment issues. The consumer must do so. By accepting these terms, the consumer accepts the method of payment set out above and acknowledges and agrees that Save Me is not responsible for or liable to the consumer in relation to the above.

15. Right of Complaint

In case of a complaint concerning a Product the Consumer shall address the complaints to Consumer Service of Save Me before taking any other action. Save Me will handle all claims (including with respect to a “Save Me Bag” and its contents) as Save Me deems correct and any decision by Save Me regarding the Product is entirely up to Save Me. In the event that the intervention of Save Me is not to the satisfaction of the Consumer, these Terms do not limit the means available to the Consumer to resolve the dispute it has with the Store under applicable law. All complaints are handled exclusively by Save Me and the Consumer shall direct complaints to Save Me and not the Store. The Consumer shall verify the content of the Products upon receipt. In case of a complaint, the Consumer shall contact Save Me via the complaint link on the Platform and provide the requested information, including information about the Product at issue and why the Consumer is unsatisfied. After receiving the complaint, Save Me will process the complaint, in cooperation with the Store if relevant, and the Consumer will receive a reply from Save Me within 10 business days.

16. Consumer Behavior/Rules of Conduct

Consumers are requested to show respect for a Store ́s guests and personnel, as well as Save Me ́s personnel. The Consumer is informed that in case of inappropriate behavior towards a Store, the other Consumers of a Store or Save Me, or if the Consumer commits a crime against or in a Store in connection with the Services, or violates the code of conduct rules of a Store or Save Me or any other similar behavior, Save Me may, in particular after complaints made by a Store, ban, exclude or suspend the Consumer from the Platform and the Services. The intervention of Save Me does not deprive a Store of the means and rights at its disposal to obtain possible reparations. Rules of Conduct for using the Services:
  • As a condition of use, you promise not to use the Services for any purpose that is prohibited by these Terms.
  • You are responsible for all your activity in connection with the Services.
  • You shall not resell or attempt to resell any Products.
  • You shall not (and shall not permit any third party to) either (a) take any action or (b) upload, download, post, submit or otherwise distribute or facilitate distribution of any content on or through the Service that: (i) you know is false, misleading, untruthful or inaccurate; (ii) contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password or other information of ours or of any third party; (iii) impersonates any person or entity, including any of our employees or representatives; or (iv) includes anyone’s identification documents or sensitive financial information.
  • You shall not: (i) take any action that imposes or may impose (as determined by us in our sole discretion) an unreasonable or disproportionately large load on our (or our third party providers’) infrastructure; (ii) interfere or attempt to interfere with the proper working of the Services or any activities conducted on the Services; (iii) bypass, circumvent or attempt to bypass or circumvent any measures we may use to prevent or restrict access to the Services (or other accounts, computer systems or networks connected to the Services); (iv) run any form of auto-responder or “spam” on the Services; (v) use manual or automated software, devices, or other processes to “crawl” or “spider” any page of the Platform; or (vi) harvest or scrape any content from the Platform.
  • You shall not (directly or indirectly): (i) decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Platform (including without limitation any application), except to the limited extent applicable laws specifically prohibit such restriction; (ii) modify, translate, or otherwise create derivative works of any part of the Platform; or (iii) copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder.
  • You shall abide by all applicable local, state, national and international laws and regulations in connection with the Services and your use of the Platform.
We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request; (ii) enforce these Terms, including investigation of potential violations hereof; (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests; or (v) protect the rights, property or safety of us, our users and the public.

17. Indemnification/Limitation of Liability

You agree to indemnify, defend and hold harmless Save Me and its parents, subsidiaries and affiliates, along with their respective employees, directors, officers, agents, business partners, affiliates, contractors, distribution partners and representatives (“SAVE ME M E PORTAL L.L.C”) from and against any and all claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to (i) your use of the Services, (ii) any breach by you of any of these Terms, and (iii) any violation of applicable law. The Save Me Group shall not be liable for losses arising out of or in connection with (i) matters for which a Store bears the responsibility, (ii) faults of third parties or through nonattributable interruption of availability of the Platform; (iii) orders by Consumers made using fraudulently obtained payment data or other contractual data (e.g., the “phishing” of credit card data, identity theft etc.); (iv) content of sites to which the Platform links, including the accuracy of the linked sites and the data protection at such site; and (v) similar events as set out under (i) – (iv). Save Me is not liable or responsible for any failure or non-compliance with respect to its Services if such failure is caused by circumstances outside Save Me’s control. Such circumstances may be but is not limited to disruptions in the operation of Save Me and/or the Store as a result of legislation, acts of state or public authorities, acts of war, terrorism, strikes, physical blockades, lockouts and natural disasters. Save Me shall only be liable for direct losses and shall in no event be liable for indirect or consequential losses. This also applies in respect to product liability.

18. Intellectual Property

Save Me retains all copyrights, trademarks, service marks, trade names, logos and other intellectual property rights or proprietary rights contained therein in all parts of the Platform (including all copies, software, graphics, designs, and), or is authorized to use it. Some materials on the Platform belong to third parties who have authorized Save Me to display the materials, such as certain third-party licensors. By using the Platform, you agree not to copy, distribute, modify or make derivative works of any materials without the prior written consent of the owner of such materials. Except as expressly set forth in these Terms, no license is granted to you and no rights are conveyed by virtue of accessing or using the Platform. All rights not granted under these Terms are reserved by Save Me. The Consumer may use the Platform and print and download extracts from the Platform for his or her personal non-commercial use on the following basis:
  • The Consumer must not misuse the Platform (including hacking or “scraping”).
  • Unless otherwise stated, the copyright and other intellectual property rights in the Platform and in material published on it (including without limitation photographs and graphical images) are owned by Save Me or Save Me’s licensors. These works are protected by copyright laws and treaties around the world and all rights are reserved. For the purposes of these Terms, any use of extracts from the Platform other than in accordance with this clause 17 is prohibited.
  • The Consumer may not modify the digital or paper copies of any materials that he or she prints in accordance with this clause 17 and the Consumer may not use any pictures, photographs or any other graphics, video or audio sequences separately from any accompanying text.
  • The Consumer shall ensure that Save Me’s status as the author of the material on the Platform is always acknowledged and referenced.
  • The Consumer is not allowed to use any of the materials on the Platform or the Platform itself for commercial purposes without obtaining a license from Save Me to do so.
Except as set forth in this Section 17, you may not use the Platform without Save Me's prior written permission. In addition, no part of the Platform may be reproduced or stored on any other platform or incorporated into any public or private electronic retrieval system or service. We do not accept any unsolicited ideas to our Platform from outside Save Me, including, without limitation, suggestions about advertising or promotions, merchandising of any products, additions to our services, or changes in methods of doing business. We may already be working on or may in the future work on a similar idea. This policy eliminates concerns about ownership of such ideas. If, notwithstanding this policy, you submit an unsolicited idea to the Platform or otherwise to Save Me, you understand and acknowledge that such idea is not submitted in confidence and we assume no obligation, expressed or implied, by considering it. You further understand that we shall exclusively own all known or hereafter existing rights to the idea everywhere in the world, and that such idea is hereby irrevocably assigned to us. Without limiting the foregoing, to the extent any such assignment is deemed unenforceable, and or to the extent necessary for Save Me to utilize your submission, you hereby grant Save Me an irrevocable, perpetual, world-wide license to use the idea and any associated intellectual property in any manner, in any medium now known or hereafter developed, without compensation to you.

19. Third Parties

When using the service, Save Me's role is to provide a platform that helps connect users to your store. Please note that Save Me does not offer, endorse or endorse any third-party products, services or information. Save Me is not affiliated with and is not responsible for the products and services of the providers featured on the Platform (including without limitation the Store). The Platform may contain links to other websites not maintained by us. Other websites and apps may also reference or link to our Platform. We encourage you to be aware when you leave our Platform and to read the terms and conditions and privacy statements of each and every website and apps that you visit. We are not responsible for the practices or the content of such other websites and apps.

20. No Warranties

WHILE SAVE ME USES REASONABLE EFFORTS TO INCLUDE UP-TO-DATE INFORMATION ON THE PLATFORM, EXCEPT FOR THE EXPRESS WARRANTIES STATED ON OUR PLATFORM, SAVE ME MAKES NO WARRANTIES OR REPRESENTATIONS AS TO THE ACCURACY OR COMPLETENESS OF INFORMATION ON THE PLATFORM. TO THE FULLEST EXTENT PERMITTED BY LAW, YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK. THE PLATFORM, INCLUDING ALL CONTENT MADE AVAILABLE ON OR ACCESSED THROUGH THE PLATFORM, IS PROVIDED "AS IS" AND SAVE ME MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER FOR THE CONTENT ON THE PLATFORM. FURTHER, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, SAVE ME DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, NON-INFRINGEMENT, TITLE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SAVE ME DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE PLATFORM OR ANY MATERIALS OR CONTENT CONTAINED THEREIN WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVER THAT MAKES IT AVAILABLE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULLEST EXTENT PERMITTED BY LAW, SAVE ME SHALL NOT BE LIABLE FOR THE USE OF THE PLATFORM, INCLUDING, WITHOUT LIMITATION, THE CONTENT AND ANY ERRORS CONTAINED THEREIN. IN NO EVENT WILL SAVE ME BE LIABLE UNDER ANY THEORY OF TORT, CONTRACT, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR ANY LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, COSTS OF COVER, EXEMPLARY, PUNITIVE, PERSONAL INJURY/WRONGFUL DEATH, SPECIAL, INCIDENTAL, INDIRECT OR OTHER CONSEQUENTIAL DAMAGES. FURTHER, TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SAVE ME BE LIABLE FOR ANY DIRECT DAMAGES EXCEEDING THE GREATER OF THE FEES YOU PAID TO SAVE ME FOR PRODUCTS AND SERVICES IN THE TWELVE MONTHS PRECEEDING THE CLAIM OR ONE HUNDRED ARAB EMIRATS DIRHAM.

21. Changes

All facts posted on the Platform are in a situation to extrude without notice. In addition, those Terms are in a situation to extrude at any time without notice. We will make such modifications via way of posting them on the Platform. You need to periodically look at the Platform for such modifications. Your perseverance get right of entry to the Platform after the sort of modifications constitutes conclusive indication of your recognition of these modifications.

22. Severability

If for any reason any part of these Terms is held or declared invalid or unenforceable by a court of competent jurisdiction, that provision shall be null and void but shall not affect the rest of these Terms. It will be modified and construed to reflect the purpose of any such unenforceable or invalid provision within the limits of applicable law or applicable court decision.

23. Waiver; Remedies

The failure of Save Me to exercise all or part of a right, or the waiver of Save Me's breach of these Terms by you, will not prevent Save Me from subsequently exercising that right. Save Me will be deemed to have waived any subsequent violations. this term or any other of these terms. Save Me's rights and remedies under these Terms and any other applicable agreements between you and Save Me are cumulative and the exercise of any such rights or remedies will be superseded by Save Me's exercise of any other rights or remedies. without limiting your rights.

24. Governing Law and Arbitration

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes (including non-contractual disputes) relating to these Platform Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.

25. Class Action and Jury Waiver

YOU AGREE BY ENTERING INTO THIS AGREEMENT, YOU AND I WAIVE YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION, CLASS ACTION, INDIVIDUAL ATTORNEY ACTION, OR OTHER REPRESENTATIVE ACTION OF ANY KIND. shall be Claims and remedies brought in a class action, private action, or other representative action shall be arbitrated only on an individual basis (non-representative action, not a class action), and the arbitrator may arbitrate only. Decision-class, non-representative) basis.
